Agreement to These Terms

Welcome to Gotham Divers! By visiting our store, using our Website at gothamdivers.com, enrolling in courses, booking rental equipment, purchasing equipment, purchasing services, or participating in a travel experience, you agree to be bound by these terms and conditions.

About Gotham Divers

Gotham Divers is a full-service one stop Scuba Diving retail and training center located at 125 East 4th St. NY, NY 10003. We are an authorized SSI Training Center (809534), PADI Training Dive Center (24427) and TDI/SDI Training Center (1004184) offering SSI, PADI, SDI and TDI certification courses, equipment sales, equipment servicing and repair, local dive charters, rental gear, and dive traveling experiences. Courses

  • You must meet the legal age and medical prerequisites stated for a given course. Students under the age of 18 require written parent or guardian consent.
  • You must complete and sign all assigned agency specific forms prior to any in-water training. Medical forms may require a doctor’s signature.
  • You must be in good physical health and disclose any medical conditions that may affect your ability to dive safely. Gotham Divers reserves the right to to require a physician’s medical clearance before any in-water instruction. Gotham Divers instructors also reserve the right to end any in-water training if it deems that a student’s physical abilities impact dive safety, and Gotham Divers may require a physician's medical clearance to restart in-water training.
  • Any course other than Open Water Diver requires a student to submit a copy of their certification card.
  • Course fees include online course materials, in-person instruction, some rental gear, and a certain number of open water checkout dives. Course fees do not include travel and accommodation, local diving fees, and some rental gear. A full and complete list for a given course can be found in the Gotham Divers online store.
  • Students must demonstrate satisfactory proficiency for all required skills of a given course in order to earn a certification. Gotham Divers instructors have the final authority on certification decisions.
  • Scuba Diving inherently involves risk of injury and death. Gotham Divers will teach students how to minimize risk of injury and death, and divers are expected to apply risk assessment to their personal training, especially diving within their limits and abilities. Participation in training and any dive activity is entirely at your own risk.

 

Course Rescheduling

  • The logistics of a Scuba diving course include instructor and pool scheduling, pool rental fees, and instructor compensation. Gotham Divers is aware that plans change and life happens and will reasonably work with students while trying to balance sustainability challenges.
  • Within 3 days of the course and with notice, students may transfer once to another course date without a rescheduling fee. If students transfer two or more times, then they will be charged $100 for every time they reschedule.
  • If a student does not give notice of rescheduling within fewer than three days and/or does not attend their scheduled class, then they will be charged a $100 rescheduling fee.

 

Course Cancellation and Refunds

Gotham Divers understands that plans change and life happens, and we have developed the cancellation policies below to create fairness, especially around the unexpected, while balancing the sustainability of the shop:

  • Fees associated with a cancelled course can be used as store credit for the purchaser or someone else deemed by the purchaser.
  • If a student has a sudden medical challenge, then the student may be eligible for a refund if they submit a doctor’s note. The refund amount is based on how much of the courses is completed.
    • If the course has not started, and a student has not started the online academics, then a student is eligible for a full refund minus administrative processing fees.
    • If the course has started, and a student has started the online academics, but has not started any in-water training, then the student is eligible to receive a refund excluding the cost of the online academics and administrative processing fees.
    • If the course has started, and a student has started the online academics and in-water training, then the student is unlikely to be eligible for a refund.
    • Gotham Divers reserves the right to reschedule or cancel courses due to insufficient enrollment, instructor availability, or unsafe conditions. A student is eligible for a full refund if Gotham Divers cancels a course or they may apply the course fee to the next available course date.

 

Equipment Rental

Rental of Scuba equipment from Gotham Divers is subject to the following terms:

  • A valid government-issued photo ID and a current Scuba certification card is required for all equipment rentals that are not part of a Gotham Divers event.
    • Dry Suit rentals require a Dry Suit certification card.
  • A credit card is needed for rental equipment that is not a part of a Gotham Divers event, and an amount equal to the cost of replacement gear will be placed on hold.
  • All rental equipment must be inspected by the customer at the time of pickup. Any pre-existing damage must be reported before leaving the premises.
  • Renters are responsible for the safe return of all equipment in the same condition as received with the exception of normal wear-and-tear. Lost or damaged equipment will be charged at the replacement cost.
  • Rentals fees are charged per day or per dive trip as quoted at the time of the reservation.
  • All divers using rental equipment do so at their own risk. Gotham Divers is not liable for equipment malfunction during use provided the equipment passed pre-rental inspection.

 

Gas Fills

  • A renter needs to provide a current Scuba certification card in order to fill a tank.
  • A renter requesting Nitrox or Trimix fills requires an appropriate certification card for the requested gas.
  • Calculating the price of a given gas fill is based on the size of a tank. The amount of gas in the tank is not taken into consideration, and may be removed in order to properly and safely fill a tank to a desired mixture. (i.e. no top ups)
  • While Gotham Divers checks the final mixture and pressure of each tank fill, it is up to the renter to check both the mixture and pressure prior to leaving the shop. Gotham Divers is not responsible for anything that happens to a given mixture or pressure once the renter leaves the shop.

 

Equipment Sales and Returns

  • In store purchases may be returned for store credit within 30 days if the equipment is operational, is in the original packaging, and clearly has not been used.
  • Wet suits, dry suits, and undergarments are non-returnable for hygiene reasons.
  • Special and custom orders are non-refundable

 

Equipment Service and Repair

When you drop off your equipment for service or repair, you agree to the following:

  • Gotham Divers will inspect all equipment upon intake and provide an estimated service cost. Additional costs may arise if additional damage is discovered during disassembly.
  • You authorize Gotham Divers to perform the agreed-upon service and to use manufacturer-recommended or equivalent replacement parts.
  • If additional work beyond the estimate is required, Gotham Divers will contact you for authorization before proceeding, unless you have pre-authorized us to a stated dollar amount on the intake form.
  • Gotham Divers is not responsible for pre-existing damage, corrosion, or deterioration discovered during service. Aluminum tanks manufactured before 1990 may be declined for service based on industry guidelines.
  • All work carries a 90-day labor warranty on parts installed by Gotham Divers under normal use conditions.

 

Charters (Local)

To participate in a local dive charter boat, you agree to the following:

  • To secure a spot on a local charter, you prepay your spot, which is equal to the individual charter boat fee.
  • If you cancel, and no one is on a waitlist or can take your spot, then the individual charter boat fee is non-refundable.
  • The captain of any charter boat has full authority to change the destination or cancel a trip out of an abundance of precaution to maintain diver safety.
    • A change in destination does not constitute a refund.
    • If the captain cancels a trip, then an individual charter boat fee will be applied to another trip or can be used as store credit. Fees can be refunded with a written request.

 

Trips (Non Local)

  • To reserve your spot on any trip, a down deposit of 15% of the total cost of the trip is required.
    • The deposit is non-refundable 21 days after the deposit transaction unless another participant is available to take the spot.
  • 50% of the balance of a trip must be paid by three months before the start of a trip date.
  • 100% of the balance of a trip must be paid by one month before the start of a trip date.
  • The refund policy for trips is dependent on the timing of the request, the type of trip, a waitlist, and if someone can be found to take your spot.
  • Gotham Divers acts as an organizer and is not the end-service provider for flights, liveaboards, or accommodations. Gotham Divers is not liable for cancellations, changes, or service failure by third-party operators.
  • All dive participants are strongly encouraged to carry dive accident insurance. (e.g. DAN)
  • Minimum certification requirements for each trip are firm, and it is the customers responsibility to ensure they meet all or obtain all requirements for booking.
